Branding and Industrial Property Pillars in the Growth of Brands
Names, logos, emblems, colors, shapes, sounds and even smells are often the face of companies, professionals and entrepreneurs, regardless of the activity they are involved in, or the market they are targeting, much less their size, since they find in the trademarks an infallible letter of presentation, but to get the public to unequivocally link the trademark with its proprietor, first the proprietor must “build his trademark”, that is, it must take a series of steps that allow it to create its original and unique distinctive sign, using branding and industrial property to achieve it.
Branding, is a tool of strategic and creative management of all those elements that differentiate the identity of a distinctive sign, which if used properly, and without losing sight of the guidelines of industrial property, may result in a distinctive sign with a unique value proposition or competitive advantage, with its own personality, values and attributes, that will act as a communication link for the quality of the products or services that support the brand, thus increasing consumer loyalty. On its own, the Industrial Property through the multiple figures, grants protection to the original, distinctive and unique signs, encourages creativity and fair economic competition, the protection of consumers and of course the commercial agents.
By using branding and Industrial Property as pillars in the creation and growth of trademarks, they have a better chance of generating strong and suitable trademarks for their registration and protection, which give their proprietor the right to use them exclusively, as well as to authorise third parties to use them or to object to their making use of them, either for products or services similar to or identical to those protected by them and even in some cases for products or services other than the same ones they protect, but that when used on them it could cause a dent in their fame or prestige.
