Chinese steel nails and their countervailing duty.
The Ministry of Economy published in the Official Gazette of the Federation, the FINAL resolution of the administrative procedure for the examination of the validity of the countervailing duty imposed on imports of steel nails to concrete originating in the People’s Republic of China.
It should be noted that the resolution in question has as a background the final resolution of the antidumping investigation on imports of steel concrete nails originating in the People’s Republic of China that was published in the Official Gazette of the Federation on November 29, 2004 and in which it was determined to impose a definitive countervailing duty of 0.50 US dollars per kilogram.
On May 16, 2011, the final resolution of the first examination of the countervailing duty was published in the Official Gazette and it was determined to modify the countervailing duty to 0.50 to 0.54 and to extend it for five years.
Subsequently, on November 10, 2015, the final resolution of the second examination of the validity of the countervailing duty was published in the Official Gazette of the Federation and it was determined to extend it for five more years.
By means of the publication of the notice on the validity of countervailing duties dated September 11, 2018, domestic producers and any person having a legal interest were informed that the definitive countervailing duties imposed would be eliminated as of the date of their expiration.
At this stage, the companies Clavos Nacionales México, S.A. de C.V. and Deacero, S.A.P.I. de C.V., expressed their interest in having the Ministry of Economy initiate the examination of the validity of the countervailing duty in question. For this reason, on November 19, 2019, the resolution initiating the examination of the validity of such duties was published in the Federal Official Gazette.
The Ministry of Economy has terminated and concluded the procedure for the examination of the validity of the countervailing duty imposed on imports of steel concrete nails entering through tariff item 7317.00.99 of the Tariff of the Law of General Taxes on Imports and Exports (TIGIE), and has determined to eliminate the countervailing duty imposed on imports of steel nails.
