How to register a trademark?

The Procedure for Registering a Trademark in Mexico begins with a trademark registration application that must be filed with the trademark office of the Mexican Institute of Industrial Property (IMPI), where a series of data must be recorded (the mark to be registered, class, goods or services, date of first use, etc.), then the IMPI makes a formal examination, by which it verifies whether in the application all the formal requirements established in the Law and its Regulations were met.
Upon completion of the formal examination, the IMPI conducts a substantive examination, by which it must determine whether the mark meets the requirements of registrability stipulated in the Act. If it is concluded that the application submitted does not meet these requirements, the Institute communicates this situation in writing to the applicant, who has a period of two months to remedy the errors or omissions that have been made in the application submitted. If no reply is submitted within the prescribed period, the request is deemed abandoned.
If the application is found to comply with the requirements laid down by law, or, once the errors or omissions in which it was made have been remedied, and if deemed appropriate, the appropriate registration certificate is issued, which will be published in the Gazette.
If, on the other hand, registration is refused, such refusal may be challenged by means of an appeal for review, or by the Administrative Litigation Court, and at the end of the case, by direct amparo before a Collegiate Circuit Court in Administrative Matters.
