Law Offices and Notaries in the Sight of Raquel Buenrostro
On Wednesday, June 3, 2020, the newspaper La jornada published an interview with Raquel Buenrostro, head of the Tax Administration Service.
In the last 5 months, the SAT has collected 50 billion pesos, derived from its oversight processes. In 2019 it raised 37 billion pesos in the entire fiscal year, so they estimate that this year they will raise approximately 70 billion pesos.
This has been achieved because President Andrés Manuel López Obrador announced that the federal government was looking for 15 large companies to catch up on their taxes, since he has announced that there will be no preferences, benefits, or pardons for anyone in his government.
Raquel Buenrostro mentions that these companies are located in the following sectors:
“Steel, food, automotive, energy, pharmaceutical, financial, mining, retail (retail) and hydrocarbons.”
These companies were identified with fiscal planning that borders on tax fraud and, in many cases, are represented by the same law firm
Raquel Buenrostro, who mentions that it has been possible to negotiate with these companies because they are large and listed on the stock exchange, and that it is therefore not in their interest to be in the midst of scandals, as it may have repercussions on their image and actions, That way, they can lose more by the fall of their shares than by covering their taxes.
Finally, Raquel Buenrostro invites companies to approach the SAT and also mentions that one of its objectives is to raise tax revenue without the need for a tax reform that raises taxes.
He mentions that it is possible to raise the collection rate by monitoring tax obligations more closely and target firms that encourage the use of “alternative strategies”. So he’s targeting law firms and notaries for helping companies evade the IRS, which is why, he says, they’ll start auditing them.
