What products or services can I protect with a trademark?
Today we have the task of analyzing and making known the classification of Products or Services that can protect a Registered Trademark, taking into account that the purpose of these, is precisely to offer the consumer public some product or service that will undoubtedly be associated with the brand established for such purposes.
It should be noted that this distinction or classification between Goods or Services has been established internationally through an instrument known as the “NICE Classification“, established by the Nice Agreement in 1957, is an international classification of goods and services that is applied for the registration of trademarks, and arises because of the need to regulate trademarks.
The purpose of this classification is to ensure that the filing of trade mark applications is carried out under a single classification scheme, Thus, the preparation of such applications is considerably simplified by having a uniform classification that is accepted in three quarters of the world. For this reason, when the registration of a new trademark is requested, the Law on the Subject requires the specification of the class for which the trademark is intended to be registered and the list of goods or services to be protected.
The importance of the Nice Classification lies in the fact that the protection of a certain mark IS AT AN INTERNATIONAL LEVEL, thus preventing the registration in the member countries of the Nice Agreement of a mark protecting the same goods or services of another already registered.
Below are some examples of classifications for both Products and Services:
-Chemicals used in industry.
-Metals and alloys
-Lighting or heating equipment
-Non-metallic construction materials
-Advertising, business management
-Transport, packaging and storage of goods
-Treatment of minerals
-Scientific and technological services as well as related research and design services; industrial research and analysis services; computer and software design and development.
-Services provided by jurists, legal assistants and counsellors to individuals, groups of persons, organizations or companies; research and surveillance services related to the security of persons and communities; services provided to persons in connection with social events, such as escort services, marriage agencies and funeral services.
As a result, it is imperative that, in order to obtain a trademark registration, the class of goods or services that it seeks to protect is established concretely and correctly, in accordance with the provisions of the Nice Classification.
