Request for Indirect Protection by Covid-19

In recent days, international experts have criticized the measures implemented by the Mexican government to stop the global pandemic by COVID-19, pointing out that the strategies implemented are insufficient to slow the advance of the disease.

Article 4 of the Political Constitution of the United Mexican States protects the human right to the enjoyment of the highest attainable standard of health and to life.

Under this premise, a number of citizens have requested the protection of their human right to health and life from federal judges through the indirect administrative amparo proceedings, pointing out as a claimed act the omission on the part of the authorities responsible for implementing and issuing the sanitary containment measures and actions, in order to avoid contagion, to avoid preventive measures to detect cases of people infected with the COVID-virus19 and to prevent its spread on Mexican territory, since there is a danger of delay in the face of acts that are difficult and even impossible to repair.

It is the case that the authorities designated as responsible are:

1.- The President of the United Mexican States

2.- Head of the Ministry of Health

3.- Undersecretary of Prevention and Health Promotion

4.- Director General of Epidemiology

Because of the above, federal judges have begun to grant suspensions that pressure the Mexican government to apply stronger measures against the spread of the Covid-19, requesting the authorities to implement the preventive measures and actions they have taken to detect persons infected with the Covid-19 virus, in order to guarantee the human rights to health and life, which the Mexican State is obliged to protect and guarantee in a timely and effective manner.

Of course, the demand for indirect protection is a right that all citizens have; however, the fact that the Mexican Government is not doing what is necessary to contain COVID-19 falls into the realm of subjectivity; since in each country there are different measures, from total isolation to measures that seek to mitigate contagion. In the face of this, only time can justify it.
