Stearic acid and its countervailing duties.

The Ministry of Economy published in the Official Journal of the Federation, the decision terminating the administrative procedure for the examination of the validity of the countervailing duties imposed on imports of stearic acid originating in the United States of America.

It should be noted that the decision in question is preceded by the Final Resolution of the anti-dumping investigation concerning imports of stearic acid originating in the United States of America, which was published in the Official Journal of the Russian Federation on 8 April 2005 and in which countervailing duties were determined as follows:

a. 5.18 per cent for imports produced and sourced from Cognis Corporation;

b. Of 17.51% for imports produced and from Uniqema Americas, LLC;

c. Of 27.77% for imports produced and from Ferro Corporation;

d. 36.51 per cent for imports produced and sourced from The Procter & Gamble Distributing Company; and

e. 36.51 per cent for imports from all other United States exporters.

On October 7, 2011, the Official Gazette of the Federation published the final resolution of the first review of the validity of the countervailing duties and decided to modify them to 17.38% and maintain them for five years.

Subsequently, on May 9, 2016, the final resolution of the second review of the validity of the countervailing quota was published in the Official Journal of the Federation and it was determined to maintain it in force for five more years.

Through the publication of the notice on the validity of countervailing quotas dated 28 August 2019, domestic producers and any person having a legal interest were informed, that the definitive countervailing duties imposed would be eliminated as from the date of their expiration.

At this stage, the company Quimic, S.A. de C.V. expressed its interest in the Ministry of Economy to begin the review of the validity of the countervailing duties in comment, However, the company did not submit a reply to the official form, arguments or evidence.

On the basis of the foregoing, the Ministry of the Economy declared the procedure for examining the validity of the countervailing duty imposed on imports of stearic acid originating in the United States of America terminated and eliminated the corresponding countervailing duties.
