The Industrial Designs
The Industrial Designs are part of the strategic elements in trade, due to the decorative and aesthetic value that they offer to the products. Industrial designs play a very important role in the competitiveness of companies, allowing them to set their product in the preference of consumers and the general public.
For this reason, it is transcendental to protect them through an industrial design registry, which is a privilege that confers an exclusive exploitation right granted by the State, that is, by the Mexican Government through the Federal Public Administration, by the Industrial Property Mexican Institute, to the person who performs an industrial design and / or its owner, helping to prevent third parties from taking advantage on their unauthorized use or using in their products an Industrial Design identical or similar to the one already protected.
Among the industrial designs that can be protected are industrial drawings, which are all combinations of figures, lines or colors that are incorporated to an industrial product for ornamental purposes and that give it a peculiar and distinctive aspect, that is, they are two-dimensional industrial designs, whose purpose is to constitute the aesthetic part of the products, making them attractive for consumers and the general public, thus improving their acceptance and preference.
While industrial models are those industrial designs made up of three-dimensional shapes that serve as a pattern to manufacture industrial products, giving them a special and unique decorative appearance but that does not imply technical or functional effects.
The protection granted to industrial designs is five years, with the possibility to renew it for periods of the same time to complete a maximum of twenty-five years.
