Visas in Mexico

The people’s movement from its place of origin or residence to another whether inside or abroad has made that States who receive either by short or long periods to these migrant people, issue within its national legislation the corresponding dispositions that rule transit or given the case, the temporary or permanent residence in these countries. Likewise, so they can get in with their families and carry out activities that remunerate them economically.

Mexico isn’t the exception, according to its migrant policy and attending the principle of “Easement of people’s international mobility, protecting order and security “It’s established that foreign people who want to get in or out from the country must fulfill the requirements demanded by the Immigration Law, its regulations, and else applicable legal dispositions.

In consequence, it’s determined that in the country the Interior and Foreign Affairs Ministries will be the ones authorized to jointly determine the legal instrument that establish the standards to issue visas, that at all time have a coherent migrant management as a priority, that grants easement for its issuance; with the purpose to favor the regular and organized migrant fluxes, watching above all the foreigners’ dignity.

A visa’s the authorization granted to a foreign nationality person to appear in a place destined to people’s international transit and request, according to its visa, its staying, as long as the other requirements are gathered for admission. This authorization is usually printed or stuck on to a passport or travel document, although it can also be granted through electronic media or electronic records.

According to what’s written on the 40th and 41st article of the Immigration Law, it’s the consulates’ job, placed in the countries that have diplomatic relationships with Mexico, the paperwork, authorization, and issue of the following visa types:

• Visitor Visa without permission to perform economic activities.
• Visitor Visa to do adoption paperwork.
• Temporary residence Visa
• Temporary residence student Visa
• Permanent residence Visa

While the following listed Visas must be processed and authorized before the Immigration National Institute and issued only by the consulates:

• Visitor Visa without permission to perform economic activities, when requested by humanitarian reasons,
• Visitor visa with permission to perform economic activities when they derive from a job offer,
• Temporary residence Visa when it’s requested by a job offer or family unit.
• Permanent residence Visa when it’s requested by the points system, family unit and due to the refugee condition acknowledge.

We must precise that the Visas previously mentioned are granted to foreigners with an ordinary passport, that is to say, they do not belong to their country’s government or perform a public position neither are members of the diplomatic or foreign service.

Likewise, it’s important to stand out that Mexico has entered into and or issued, in a bilateral and unilateral way, agreements or instruments where it decrees the Visa suppression, that is to say, they do not require to get a Visa to go through the immigration check filter and request their entry into the country   under visitor stay condition without permission to perform paid activities.
