Wind towers and its countervailing duty.
The Ministry of Economy published in the Official Journal of the Federation the FINAL resolution of the anti-dumping investigation on imports of wind towers originating in the People’s Republic of China, regardless of their country of origin.
The product under investigation was steel structural towers or posts, assembled or unassembled, including their sections (“wind towers”). The generic, commercial and/or technical name under which the product under investigation is known is a wind-powered structural steel tower, wind tower, wind tower, wind-powered structural tower or wind-powered tubular tower.
The wind towers are a hollow conical-shaped support structure of high-yield structural steel, formed by sections of rolled and welded steel plate, flanged at the ends of each section on which the wind generation system is placed and enters the domestic market according to the following tariff description:
For the goods under examination identified above and coming under tariff item 8502.31.01, the investigation procedure concerning unfair international trade practices was concluded, in its form of price discrimination and a definitive countervailing duty of 21% is imposed on imports of wind towers originating in China, and will be applied on the customs value declared in the relevant pediment.
It is important to note that importers will not be obliged to pay this countervailing duty IF THEY FIND THAT THE COUNTRY OF ORIGIN OF THE GOODS IS DIFFERENT FROM THE PEOPLE’S REPUBLIC OF CHINA.
